A update to this from a friend of mine.
It seem e-mail are now coming back as not able to delivered them to the person. The phone number is going on to a answer machine, but calls are not being returned. It has been reported that they were moving the server from Wakefield to London and it was suppose to be done by Monday. The bit i don't understand is, he contacted Kingston Communications, who say they have no record of Fotopic, Snappy Design Limited or Any Web Group. I know i tried is site yesterday and i got a message up from Virgin, saying there was no such web site of that name. Looking on Facebook, some people are talking about see a solicitor.
Hope this help the many people on here who have lost their stuff.

So who is right?

I dont want a solicitor as i only bought space and not bought or sold anything. I want my gallery back. Ive even e-mailed watchdog.

Maltaboy, i agree with you, people are guessing and reading into what they can. But on the other hand people are trying to share as much information as they can, to try and help out other people. I does not bother me if it comes back or not as i have not got a account with them, i only you proboard or photobucket, but a lot of my friends have, so any news either good or bad is useful.

All that is happening is confusion is been caused. But any information is better than none. Its not as frustrating knowing that its effecting lots of people and not just me. As ive said previously if Fotopic are simply having difficuties then they must somehow be able to post a message so everyone knows whats going on. Its the poorest of poor customer service not to keep subscribers informed as to whats going on, and to be honest from some of the people ive spoken to if they do come back online, a free extension to there quota as an appology wont be enough!

According to Joel Rowbottom who created Fotopic, the servers and alot of the other eqipment was moved down south in 2009, this is what apparently led to the down time then, and again if they were simply moving servers, wouldn't they have informed gallery owners that there may be some reliability issues while this happened!

Wikipedia says; Joel is now at the final stages of launching a new photo hosting package which will probably (I know little detail) be significantly different from Fotopic in some functionality as it takes account of the way people network nowadays which has changed significantly from when Fotopic was launched. This site is www.pikfu.com, something to which there has been a lot of reference in recent discussions. It is now being launched in something of a hurry to fill the void and will only have limited functionality to start with. Joel knows no more than we do so there's no point in keep asking him! Even if he really does and isn't telling, asking once more isn't going to make a difference.

This is the same Joel who is helping out on the Facebook Fotopic forum at the moment. The difference is on that site people want information and as much as they can get and must say a lot of people are helping.
